Justice Department Appeals Federal Judge’s Block of Third Country Deportations

The Department of Justice (DOJ) has asked the Court of Appeals for the 1st Circuit to halt a broad order issued by a judge, effectively blocking the deportation of illegal immigrants to third countries. This ruling came after several immigrants with final removal orders from the Department of Homeland Security (DHS) stated that they did not receive enough notice to contest their removal, claiming a threat of torture in the countries to which they would be deported.

Judge Murphy stated in his 81-page ruling that the government’s refusal to provide prior notice to deportees “fails to satisfy due process.’”

The Justice Department stated that Massachusetts Judge Brian Murphy’s decision could affect sensitive diplomatic negotiations, and possibly “thousands” of deportations. U.S. attorneys wrote, “The Supreme Court twice stayed the district court’s sweeping nationwide, classwide preliminary injunction.” They asserted that Judge Murphy tried to evade this by issuing yet another order. 

The Justice Department explained that the policy, which allows third-country deportation, is based on assurances provided by those countries to President Trump’s administration. The department also said that this issue falls under the supervision of the executive branch.
